There's a lot of fine print in here - most of it just common sense. We want you to be satisfied with your purchase and we will do our best to correct problems that can and do unfortunately sometimes occur. Please keep in mind that should a problem exist with your order it is equally frustrating for us too. We will try our best to resolve your issue in a reasonable time.

This document summarizes information, terms, and conditions pertaining to questions and/or circumstances which may arise in the course of our business. Throughout this document, the words we, our, and us, refer to Proformance. The words you, yours, and customer, refer to the purchaser (individual or business entity).

PURCHASES

Price Changes
All prices and specifications are subject to change without notice. Prices advertised on this website may not reflect the actual current selling price of an item due to price fluctuations, minimum advertised price requirements, or other circumstances. Our price assurance policy guarantees that your price will be equal to or lesser than our currently advertised price for all products currently in stock. You will be notified before shipping if changes in the cost or availability of an item not in stock causes the actual selling price to be higher than that shown in our advertising. You may cancel or modify your order if desired at that time.

Warranty
All products are covered by an original manufacturers warranty against manufacturing defects which may vary from 90 days to 1 year or more depending upon the product and manufacturer. Ask your salesperson for information about the warranty period for any specific product. Warranty coverage excludes normal wear and tear, or damage caused by improper installation, any modification, abuse, misuse, improper maintenance, and unauthorized repairs or modifications to the original product. Warranty does not cover those parts prone to failure under normal wear and tear such as bulbs, brushes, fuses, and belts.

Ordering
Minimum order is $150 net merchandise value for all domestic U.S. and Canadian orders. Orders which fail to meet the minimum requirement may be refused or subject to a $10.00 handling charge at our discretion. Orders may be made by any of the following methods:

First Time Order
New customer orders must be prepaid by credit card, or approved check. We do not ship C.O.D.

Valid purchase orders accepted from credit approved businesses and institutions. For first time orders include Dunn's number and relevant credit information.

Payment
Payments may be made by check, cash, money order, or major credit card including Visa, MasterCard, American Express, and Discover.

Credit cards
We accept major credit cards including MasterCard, Visa, American Express, and Discover for all payments or deposits, subject to verification and approval by the issuing bank. There is no additional fee for payment with a credit card. (You may accrue regular interest charges on your credit card account assessed by the issuing bank.) Purchases made using a credit card are shipped "pre-paid" with charges being posted when products are available and made ready for release or shipment to the customer via common carrier.

Refusal: We may refuse to accept any credit card for payment where: authorization cannot be obtained; the card appears to be altered or mutilated in any way; the expiration date has passed; the card is unsigned or the signature on the card does not match the signature of the sales record; where the identity of the cardholder cannot be verified, or the cardholder and purchaser are not the same person; where the billing address cannot be verified; or where the billing and shipping information provided does not match.

Verification: In an effort to reduce credit card fraud we may request additional information before accepting your credit card. For orders placed by mail, telephone, email, our website, and/or where the ship to address is different from the billing address, we may request a faxed signature and photocopy of the the credit card being used. These precautions are in the interest of protecting you, our customer, as well as ourselves. We appreciate your understanding. 

Checks
Purchases prepaid using a company or personal check may be delayed a minimum of 10 days (or longer if necessary) to guarantee funds have been paid to us by the issuing bank or financial institution. Overnight, express, or rush shipments are not available for merchandise pre-paid by check.

Return check charge
A $20(US) handling fee will apply to any and all checks returned unpaid for any reason. Proformance reserves the right to rescind any contract offer, delay shipment, or restrict payment options where any checks presented for deposit are returned for insufficient funds.

Late fees
Invoices outstanding 30 days or more will accrue late fees at the rate of 1.5% monthly. Customer will be responsible for any additional recovery and court costs, legal fees, or other expenses involved in the collection of any overdue amounts.

SHIPPING

Shipping Method
Please give shipping instructions when ordering. If no instructions are given we will ship best way at our discretion - usually UPS regular ground freight service or US Postal Service.

Express Air Shipments
UPS and FedEX express air and overnight delivery is available on certain products at an additional cost. When selecting a shipping option customers' should be advised that orders placed after 2:00 pm (eastern standard time) may not be processed in time for shipment the same day.

Shipping Charges
You pay the actual shipping charges including an amount for packaging and handling, insurance, and/or drop-shipment. Minimum shipping charge for any order is $7.95 (USD). Rush orders may incur additional handling charges. Shipping charges will be added to the final balance of your order. Shipping amounts calculated online via our shopping cart are estimated for domestic (USA) shipments only, and may be adjusted where necessary.

Online Estimates
The shipping charges calculated by our online shopping cart are only an estimate, and in some cases may differ from the actual shipping charges based on your order and selection of shipping options. Where that estimate is too high, we will adjust the amount prior to billing your account.. We will notify you before shipping your order should the estimated charges ever be insufficient to cover the actual cost of shipping and handling your order.

International shipping fees will be higher than those estimated online. International orders may also be subject to additional duties and/or taxes. You are responsible for all import duties and taxes related to your order.

Return Shipping
Unless otherwise authorized by us, you must prepay the freight on any items returned for refund, credit, exchange, or warranty service. Call us for a return authorization number and shipping instructions before attempting to return an item. No returns accepted without an R.A. number.

All shipping charges are non-refundable, and we are not responsible for shipping errors based on faulty information you have provided us by telephone, mail order, or any online form. Please carefully check the accuracy and spelling of all orders before submission. Orders returned to us by the carrier as undeliverable will be credited for merchandise value only, less any additional shipping costs incurred.

Goods Damaged in Shipping
We do our best to package your order for safe transit, and insure most shipments for their full value. Problems can sometimes occur however, and you should refuse delivery of any carton which is already open, broken, or obviously damaged in such a way as to suggest that the goods inside might be permanently damaged or lost.

If you do receive goods damaged in transit, you should contact the carrier immediately  to file a claim, or contact us at 1-800-439-3277. Keep all original packaging material, and the broken product, or pieces. Do not discard anything since these items must be available to the carrier should either you or Proformance file a claim with the carrier for goods damaged in transit.

RETURNS

Please read and follow these instructions before attempting to return
merchandise you have purchased from Proformance:

All returns require a Return Authorization Number (RMA). Products returned without an authorization number will be refused. To obtain a RMA contact us at returns@proformance.net or call: (978) 887-6008 between 10:00 am and 6:00 pm EST.

Defective merchandise will be exchanged for identical items up to 21 days after purchase. Warranty repairs and defective products must be returned with original packaging material and box in good condition. Please include a description of the defect or problem experienced. Repair or replacement of products will be at our discretion.

Replacement products will be shipped or a credit/refund issued only after the return and evaluation of the defective merchandise.

Non-defective product returns will be subject to a 15% restocking fee. Items must be returned complete and in their original packaging. Consumables including light bulbs, novelties, and opened containers of fluid are non-retrunable.

Shipping charges are non-refundable. Returns should be shipped prepaid, no COD or freight collect shipments will be accepted, and no call tags will be issued.

Units serviced or replaced under warranty will be return shipped to you at our expense.

  • Your return be accompanied by a copy of your original invoice.

  • You insure your return when shipping.

  • Allow a minimum of two weeks for a return to be received & processed.

PRIVACY NOTICE

At Proformance we respect your privacy whether you're a first-time visitor or a dedicated customer. We do collect information from you, but our policy is to ensure that all personal information remains private to the extent that customers and visitors wish it to remain private. To earn your trust and confidence in our site, we are disclosing our privacy practices and the uses of the information we gather.

To protect your privacy, Proformance provides a notice and a link to this privacy notice on all pages where we collect personal identifying information. We will use personal identifying information about you in a manner consistent with this Privacy Notice.

How we use your information

Proformance collects information from all visitors to our site, including IP address, operating system, and browser software. Using your IP address, we can determine your Internet Service Provider and your geographic location. This information reflects the population as a whole rather than focusing on individuals, and we use it to identify the most popular areas on our Web site and evaluate the effectiveness of our promotional activities.

Proformance does not collect the e-mail addresses of people who communicate with us via e-mail; we use the addresses only to respond to customer requests.

Information collected through online forms

We may obtain personal identifying information which includes: home or other physical address, phone number, and other information when you complete and submit one of our online forms. We collect this information at various locations throughout the site, including: information request forms, booking requests, reception planners, and emails. We give notice at each location that asks for personal identifying information that such information will be used only for the purposes stated at the location of the collection, and/or within this Privacy Statement. When we collect personal identifying information, you will always have the choice of whether or not to provide it. However, you may not be able to receive certain information or services without providing the information requested.

We use this information only for our own administrative purposes and sales response. We do not collect information for marketing purposes, or for distribution or use by any third party.

Credit Card Information
Personal identifying information and credit card numbers you submit while using our online shopping cart is used solely for the purpose of servicing and fulfilling your order. We do not compile and store this information, trade, sell or otherwise disseminate this information to any third party.

Please be aware that Proformance does not control the acts of other web sites. You should be aware that when you link, or click on ad banners, they might go to other sites not operated by Proformance. These outside parties may have different privacy policies from those of Proformance. If you are asked to divulge personal identifying information at any point outside Proformance, please be aware that privacy policies other than our own may apply to the collection and use of that information. Proformance does not control and does not assume any responsibility for any actions of third parties sites.
